Historic Vote Approves Use of PEX Plastic Pipe

The Building Standards Commission this week unanimously adopted emergency regulations allowing the use of PEX Plastic Pipe on a statewide basis.

Secretary Bill Leonard, who also serves as BSC chairman, indicated his support for this historic vote that appears to bring to an end this legal and administrative battle that started in 1982.

Unlike previous votes on plastic pipe, this latest vote ratified a legal settlement agreed to by the litigants, including the State Pipe Trades Council.

Late Thursday, BSC posted a formal notice of the action and officially announced the PEX exclusion has been removed from the California Plumbing Code (CPC).

"The Commission's action allows the statewide use of PEX in hospitals, clinics, schools, residences and commercial structures," the notice reads. "The effective date of this action is August 18, 2010 for the 2007 CPC and January 1, 2011 for the 2010 CPC."

Earlier in the week, all parties involved released a statement on the settlement. In conclusion, the statement reads, "The settlement resolves all the litigation concerning the PEX regulations, which took effect today."
